  • Company (referred to as either "the Company", "We", "Us", "Our", ''PULSE'' or ''PULSE Sport'' in this Agreement) refers to PULSE Sport B.V., located at De Boelelaan 1085, 1081 HV Amsterdam, Netherlands.   • Cookies are small files that are placed on your computer, mobile device, or any other device by a website, containing details of your browsing history on that website among its many uses.

  • Device means any device that can access the Service such as a computer, a cellphone, or a digital tablet.

  • Personal Data is any information that relates to an identified or identifiable individual.

  • Service refers to the software, mobile applications, and cloud-based solutions provided by the Company, accessible from www.pulsesport.tech.

  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • Website refers to PULSE Sport, accessible from www.pulsesport.tech.

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

1. Introduction

This Privacy Policy outlines our commitment to protecting the privacy of users of our software and services, including a mobile app for athletes and a cloud-based dashboard for coaches and staff members.

2. Information Collection and Use

We collect various types of information, including personal, health, and performance data, through external tools (phone, other wearables) and sports psychology screening questionnaires. This data is used to provide personalized recommendations, enhance performance, and prevent injuries and mental health issues.

PULSE integrates with IOS health app (Apple Health Records API) and Android health apps (Google Fit, Health Connect, etc.) to securely export health metrics such as Heart Rate Variability, Resting Heart Rate, VO2 Max, and Sleep Hours. This data is stored in the Firestore database to enhance user privacy and security. The collected data is used exclusively for calculating the PULSE Score, enriching survey inputs, and generating detailed reports to inform tailored health improvement strategies.

PULSE Sport provides a Menstrual Cycle Monitoring feature designed to support female athletes by allowing them to log and monitor data related to their menstrual cycle, associated symptoms, and general well-being.

By opting to use this feature, users expressly consent, in accordance with Article 9(2)(a) of the GDPR, to the collection and processing of special categories of personal data, including but not limited to:

  • Menstrual cycle start and end dates;

  • Physical and emotional symptoms (e.g., pain, fatigue, mood, digestion);

  • Sleep quality, appetite, and energy levels;

  • Information relating to contraceptive use and hormonal birth control (if voluntarily provided).

This data is used for the following purposes:

  • To provide insights and trends based on historical entries and self-reported symptoms;

  • To support authorised coaching and performance staff in making informed, athlete-centered training decisions;

  • For the maintenance, debugging, and improvement of our systems and digital infrastructure;

  • For internal research, data analysis, and the development of machine learning algorithms and AI-based features aimed at improving user experience and insight accuracy.

Data collected through this feature may be accessed by authorised staff within the sports organisation with which the user is affiliated. Such access is restricted to personnel who have a legitimate interest in supporting athlete performance and well-being.

Pseudonymized data may be used internally for AI development and insight generation. All such processing is conducted under strict technical and organisational safeguards.

Use of Data for Applied Research, Scientific Research, Product Improvement, and AI Training.

We may use anonymised and/or pseudonymized data collected through our services for scientific and applied research purposes, including but not limited to performance optimisation, injury prevention, mental and physical health studies, and product development. This data is stripped of personally identifiable information and analysed in aggregate to ensure user privacy. We commit to handling all data used in research in accordance with standards of data protection, and in compliance with applicable laws, including the GDPR.

Users retain the right to withdraw their consent or request the erasure of their menstrual cycle-related data at any time, in accordance with Article 17 of the GDPR. To exercise this right, users must submit a written request to contact@pulsesport.tech. Upon verification of identity, such data will be erased within thirty (30) days.

3. Consent and Data Management

By using our services, users consent to the collection and processing of their data as outlined in this policy. Users have the right to access, rectify, and request the deletion of their personal data.

Users retain full control over their data, with the ability to manage data sharing preferences directly within the app or through Apple Health settings. This ensures a commitment to user privacy and data autonomy.

4. Data Sharing and Disclosure

Data is shared only with authorized personnel within sports organizations, such as coaches and medical staff. Disclosure to third parties occurs only under legal obligations.

We do not share user data with external entities. Access to the data is strictly limited to PULSE Sport B.V.’s administrators and software developers who require this information for app functionality and maintenance, reinforcing our commitment to data protection and user privacy

5. Data Security

We implement robust security measures to protect user data from unauthorized access, alteration, and disclosure, in compliance with GDPR and other data protection laws.

6. International Data Transfer

Data may be transferred across borders, subject to strict data protection standards and in compliance with applicable international data protection laws.

7. Data Retention

We retain personal data only for as long as necessary for the purposes set out in this policy.

 

Personal data related to health metrics exported from Apple Health is retained only as long as necessary to provide our services and for the purposes set out in this policy

8. Account Management, Data Deletion and Retention

If you wish to delete your account, you may do so directly through the app. Upon deletion, we will permanently remove all personal information linked to your profile, including your name, email address, gender, age, weight and height.

Please note: we may retain anonymized data collected from your usage to support our analytics and improve our software for future users. This data will no longer be associated with any personally identifiable details, ensuring that your privacy is fully protected.

9. Children's Privacy

Special care is taken to protect the privacy of minors. We do not knowingly collect information from children under the age of consent as established by local law.

PULSE Sport recognizes the importance of protecting the privacy of children. If you are under the age of 13, you must have your parent or guardian's consent to use this app. We comply with the Children’s Online Privacy Protection Act and do not knowingly collect or solicit personal information from children under the age of 13 without parental consent.

Our app collects various types of data, including personal, health, and performance data from devices and questionnaires, which is used to provide personalized recommendations and enhance safety. For our users under 13, all data collection and processing is subject to rigorous safeguards to ensure their privacy and safety. Parents or guardians can review, amend, or delete their child's information at any time by contacting our support team.

We encourage parents and guardians to monitor and guide their children's use of apps, including PULSE Sport, to ensure a safe and beneficial experience.

1. Introduction

These Terms and Conditions govern the use of our software and services, including the mobile app and cloud-based dashboard.

2. Service Description

We provide a comprehensive software solution for monitoring and enhancing athlete performance, health, and team environment.

3. User Responsibilities

Users must adhere to proper use guidelines and are responsible for the security of their account information.

4. Health-Related Services

By accessing and using the Menstrual Cycle Monitoring feature, the user:

  • Acknowledges and agrees that PULSE Sport may collect and process sensitive health data, including menstrual cycle and contraceptive-related information, for the purposes set out in the Privacy Policy;

  • Grants permission for this data to be shared with authorized coaching and medical staff within the user’s sports organization or club;

  • Grants PULSE Sport the right to use such data, in pseudonymized form, for internal system maintenance, debugging, and technical troubleshooting;

  • Consents to the use of pseudonymized data for the training and improvement of artificial intelligence systems and predictive models developed by PULSE Sport.

Use of this feature is voluntary. If the user does not consent to the above terms, they should refrain from using the menstrual cycle-related functionality. If the feature has been already used, users can request the erasure of their menstrual cycle-related data at any time, in accordance with Article 17 of the GDPR. To exercise this right, users must submit a written request to contact@pulsesport.tech. Upon verification of identity, such data will be erased within thirty (30) days.

5. Intellectual Property

All content, trademarks, and software are the property of PULSE Sport B.V. Unauthorized use is strictly prohibited.

6. Prohibited Use

Misuse, unauthorized access, and harmful activities in relation to our services are strictly prohibited.

We reserve the right to modify or discontinue any service or feature without prior notice.

8. Disclaimer

The insights and recommendations offered by the Menstrual Cycle Monitoring feature are:

  • Generated by automated systems based on patterns observed in previously logged user data;

  • Intended solely for general informational and reflective purposes;

  • Not intended to constitute medical advice, diagnosis, or treatment recommendations;

  • Not predictive of future performance or medical outcomes.

Users are advised not to rely on this feature for any medical, reproductive, or athletic decisions requiring professional judgment. Use of this feature does not substitute consultation with a licensed medical professional. It is not intended to diagnose, treat, or prevent any medical condition.

Similarly, this applies to all other features provided by the company's products or services.

10. Disclaimer of Warranties

Our services are provided "as is" without any warranties. We do not guarantee specific outcomes, such as reduced injuries or improved performance.

11. Limitation of Liability and Indemnity

  • Our liability is limited to the maximum extent permitted by law, per incident to a maximum of the total invoice value of the twelve (12) months prior to the incident, with a maximum of 10,000 euros in total per year.

  • We exclude liability for damages resulting from inexpert use, or for use outside the intended purposes of the products.

  • We are not liable for indirect damages, including consequential damages, loss of profit, or business interruption.

  • We may engage third parties in agreement performance, accepting any liability limitations of that third party on behalf of the Client.

  • We are not liable for damages caused by third parties engaged by us.

  • We are not liable for damages resulting from incorrect or incomplete information provided by or on behalf of the Client.

  • This limitation does not apply if the damage is due to intent or gross negligence on our part.

  • A claim for compensation must be submitted within one (1) month after discovery of the damage.

12. Final Provisions

  • We reserve the right to change these Terms & Conditions without prior notice. The Client may cancel orders within 8 calendar days after such change.

  • Cancellation or modification of an agreement by the Client requires our explicit written consent.

  • If any provision of these Terms & Conditions is invalid, the remaining provisions remain in force.

  • The most recent version available on our website (www.pulsesport.tech) will apply.

13. Governing Law

These terms are governed by the laws of the Netherlands.

​

14. Dispute Resolution

Any disputes arising from these terms will be resolved through arbitration or mediation, as applicable.
