  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • Website refers to PULSE Sport, accessible from www.pulsesport.tech.

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

1. Introduction

This Privacy Policy outlines our commitment to protecting the privacy of users of our software and services, including a mobile app for athletes and a cloud-based dashboard for coaches and staff members.

2. Information Collection and Use

We collect various types of information, including personal, health, and performance data, through external tools (phone, other wearables) and sports psychology screening questionnaires. This data is used to provide personalized recommendations, enhance performance, and prevent injuries and mental health issues.

PULSE integrates with the Apple Health Records API to securely export health metrics such as Heart Rate Variability, Resting Heart Rate, VO2 Max, and Sleep Hours. This data is stored in the Firestore database to enhance user privacy and security. The collected data is used exclusively for calculating the PULSE Score, enriching survey inputs, and generating detailed reports to inform tailored health improvement strategies.

3. Consent and Data Management

By using our services, users consent to the collection and processing of their data as outlined in this policy. Users have the right to access, rectify, and request the deletion of their personal data.

Users retain full control over their data, with the ability to manage data sharing preferences directly within the app or through Apple Health settings. This ensures a commitment to user privacy and data autonomy.

4. Data Sharing and Disclosure

Data is shared only with authorized personnel within sports organizations, such as coaches and medical staff. Disclosure to third parties occurs only under legal obligations.

We do not share user data with external entities. Access to the data is strictly limited to PULSE Sport B.V.’s administrators and software developers who require this information for app functionality and maintenance, reinforcing our commitment to data protection and user privacy

5. Data Security

We implement robust security measures to protect user data from unauthorized access, alteration, and disclosure, in compliance with GDPR and other data protection laws.

Data may be transferred across borders, subject to strict data protection standards and in compliance with applicable international data protection laws.

Personal data related to health metrics exported from Apple Health is retained only as long as necessary to provide our services and for the purposes set out in this policy

We provide a comprehensive software solution for monitoring and enhancing athlete performance, health, and team environment.

3. User Responsibilities

Users must adhere to proper use guidelines and are responsible for the security of their account information.

4. Intellectual Property

All content, trademarks, and software are the property of PULSE Sport B.V. Unauthorized use is strictly prohibited.

5. Prohibited Use

Misuse, unauthorized access, and harmful activities in relation to our services are strictly prohibited.

6. Service Modifications

We reserve the right to modify or discontinue any service or feature without prior notice.

7. Disclaimer of Warranties

Our services are provided "as is" without any warranties. We do not guarantee specific outcomes, such as reduced injuries or improved performance.

8. Limitation of Liability and Indemnity

  • Our liability is limited to the maximum extent permitted by law, per incident to a maximum of the total invoice value of the twelve (12) months prior to the incident, with a maximum of 10,000 euros in total per year.

  • We exclude liability for damages resulting from inexpert use, or for use outside the intended purposes of the products.

  • We are not liable for indirect damages, including consequential damages, loss of profit, or business interruption.

  • We may engage third parties in agreement performance, accepting any liability limitations of that third party on behalf of the Client.

  • We are not liable for damages caused by third parties engaged by us.

  • We are not liable for damages resulting from incorrect or incomplete information provided by or on behalf of the Client.

  • This limitation does not apply if the damage is due to intent or gross negligence on our part.

  • A claim for compensation must be submitted within one (1) month after discovery of the damage.

9. Final Provisions

  • We reserve the right to change these Terms & Conditions without prior notice. The Client may cancel orders within 8 calendar days after such change.

  • Cancellation or modification of an agreement by the Client requires our explicit written consent.

  • If any provision of these Terms & Conditions is invalid, the remaining provisions remain in force.

  • The most recent version available on our website (www.pulsesport.tech) will apply.

10. Governing Law

These terms are governed by the laws of the Netherlands.

​

11. Dispute Resolution

Any disputes arising from these terms will be resolved through arbitration or mediation, as applicable.
